RESOLUTION TERMINATING NEW HANOVER COUNTY’S FLOCK SAFETY CONTRACT AND DIRECTING REMOVAL OF ALL CAMERAS
Resolution No. 2026-____
A short, motion-ready instrument, modeled on the Davidson County Board of Commissioners’ Aug. 24, 2026 action. The County Attorney should review before introduction.
WHEREAS, New Hanover County is the contracting party to Contract No. 25-0364 with Flock Safety, Inc. (approximately $219,000), under which automated license plate readers and Condor/PTZ video cameras are deployed in the County; and
WHEREAS, the Board holds the authority to terminate its own contracts and to control the use of county funds and property under N.C. Gen. Stat. §§ 153A-12, 153A-169, and 159-8, and this Resolution exercises only that authority and does not direct the Sheriff’s law-enforcement operations;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover County:
1. The County’s Flock Safety contract (No. 25-0364) is terminated. The County Manager and County Attorney shall give Flock Safety written notice of termination and shall not renew, extend, or amend it.
2. All Flock cameras and equipment — the plate readers and the Condor/PTZ video cameras — shall be removed from county property and county rights-of-way within thirty (30) days, and completion reported to the Board.
3. Upon termination, county staff shall cease accessing, searching, and sharing Flock data; the County’s participation in any Flock lookup or sharing network shall be disabled; and collected data shall be handled and purged solely per the applicable records-retention schedule.
4. No renewal, and no replacement automated license plate reader or mass-surveillance system from any vendor — by purchase, lease, trial, grant, or donation — shall be executed, funded, or accepted without prior authorization of this Board at a public meeting.
This Resolution takes effect upon adoption.
